SECTION 1 – GENERAL REQUIREMENTS
These Fishing Guidelines are supplemental to the Amended and Restated Declaration of Restrictive Covenants for Beaver Lakes Estates and Beaver Lakes Estates Filing #2 (Covenants) recorded in the records of Lake County, Colorado and the Amended General Club Provisions and Rules & Regulations for the Area Known as Beaver Lakes Estates and Beaver Lakes Estates Filing No. 2.
These Fishing Guidelines apply to the two lakes in common areas of Beaver Lakes Estates and Beaver Lakes Estates Filing #2 including the Lower Lake and the Upper Lake (the Lakes). Fishing on rivers, streams, beaver ponds, and other aquatic areas are regulated by the State of Colorado.
SECTION 2 – DEFINITIONS
1) Members and their immediately family – Shall mean an Owner(s). The terms Member(s) and Owner(s) may be used interchangeably. Member(s) includes children, parents and siblings by blood or adoption or any other relative that resides with the Member(s)..
2) Guests – Shall mean a Guest of the Member that is not a tenant.
3) Tenant – Shall mean any person(s) leasing a house or property from a Member for any length of time.
SECTION 3 – MEMBER AND GUEST FISHING SEASON GUIDELINES
No Commercial Fishing — Any violation will result in the Member’s loss of their fishing privileges for one year.
1) Members – Ice off Ice On (new for 2017).
2) Guests (accompanied) – Ice off through ice on as long as the Guest is accompanied by a Member on both the lower and upper lake.
3) Tenant – No tenant fishing is permitted.
4) Children – Fourteen (14) years and younger must be accompanied by an adult 18 years or older at all times.
5) Hours – Dawn to dusk (no night fishing).
6) Badges –
– New Member and Guest badges will be made available upon request to the Fishing Committee via Tim Ratterman at tim.ratterman.ble@gmail.com
– Badges will carryover from year-to-year.
– Each household can hold up to four (4) Member badges (red) and up to four (4) Guest badges (yellow).
– Up to two (2) more additional Guest badges can be purchased at a cost of $50 each.
– Lost badges within the first eight (8) badges listed above can be replaced at a cost of $20.
– Badges must be visible at all times while fishing.
– Anyone fishing who is not a Member or Guest of a Member will be considered a trespasser and the sheriff will be notified.
SECTION 4 – FISHING RULES
1) Record number of fish kept at the upper lake at the kiosk.
2) Flotation devices or watercraft of any kind are not allowed on the Lakes.
3) Do not access or interfere with the Lakes spillway structures.
4) Do not park on the dams or roadways. Park in designated areas only. Parking at the Lower Lake is located west of the dam. Parking on the Upper Lake is located east of the dam. Do not park in front of driveways or Owners’ lots.
5) The use of waders is permitted. Disinfect waders and rinse off before entering the lakes by using an all-purpose cleaner such as Formula 409. Spray the entire outside portion and bottoms of waders and scrub completely.
6) Remove and dispose of all fish kills.
7) Remove all fish line snags, trash, and debris.
8) Chumming is not allowed on either Lake.
SECTION 6 – METHODS OF FISHING
Lower Lake
1) All fishing shall be catch and release. Do not take fish from lake.
2) Flies and lures are allowed only. Only 1 treble hook on a lure is allowed.
3) All hooks will be barbless or have barbs crimped.
Upper Lake
1) Fish limit is 2 Rainbow Trout per person per day. Release all Brown Trout to help eradicate suckers. There is no limit on Brook Trout.
2) Only flies, lures, worms, salmon eggs and power bait are permitted.
3) Only 1 treble hook on a lure is permitted.
4) No live bait, minnows or leeches are permitted.
5) We encourage the use of barbless hooks for those intending to catch and release fish.
SECTION 6 – RELEASING FISH
1) Use barbless hooks or hooks with barbs crimped.
2) Wet Hands before handling or releasing fish.
3) Avoid playing fish to exhaustion.
4) Revive fish before releasing.
SECTION 7 – ENFORCEMENT OF FISHING RULES – MEMBERS & GUESTS
1) 1st Offense – A written warning will be issued to Member.
2) Each additional violation will result in a $250.00 fine to the Member
