With regards to the Plaintiffs Amended Complaint:
The Empire Lodge Homeowners Association has filed our answers per the September 19, 2019 deadline for doing so. We will keep the membership informed of further actions as they happen.

With regards to the Plaintiffs Amended Complaint:
An Amended Complaint and corresponding Exhibits 1-6 were filed by the Plaintiff’s office on September 05, 2019, via the Colorado Courts E-Filing System. The Empire Lodge Homeowners Association now has until September 19, 2019 to submit our filings.

With regards to the original lawsuit filed:
There seems to be some confusion as to the status of the case filed by one owner concerning the recent amendment to the declaration prohibiting short term rentals. At this time, while there is a lawsuit, no orders have been granted and the association has not even filed a responsive pleading. As such, pursuant to current status of the declaration, the association will enforce the provisions of its declaration as recorded. When the Association files its responsive pleadings they will be made available. However, to be clear the court HAS NOT granted any order requiring the association to refrain from enforcement.
As the Association accepted all votes in good faith, the amendment is valid and will be enforced.

With regards to ELHA Response due September 5, 2019 to the lawsuit filed:
The attorneys for the Plaintiff and the Association’s attorney have discussed the current Complaint today by phone. The attorney for the Plaintiff has determined that the original Complaint needs to be amended to more accurately reflect the Plaintiff’s position. As such, the Plaintiff will either file an Amended Complaint tomorrow or will file a notice with the Court advising the Court that the Plaintiff is amending the Complaint. Once the Amended Complaint has been served on the Association, the Association will file its responsive pleading within the allowed time frame.

With regards to the suggested “Court Ordered Injunction”. This is not a granted order. This is simply a proposed order written and submitted on behalf of the plaintiff by his attorney. We have had our attorney check two different times today to confirm and the court has not granted this order as of 1 pm on 8/31/19.
The board will continue to keep the members advised as to how these proceedings are progressing.

Whoever opens the gate must close or wait until the next person closes. The ELHA member of records is responsible for violations by guests, family members, agents, contractors, vendors, and employees.
All offenses: $250 fine.
There may occasions, during the winter months, when the upper gate may be left open, but only when permission has been received from Jim Moyer. Signs on the upper gate will inform you when it can be open and when it must be closed. The bottom gate must be closed at all times.
